How is overtime pay calculated under FLSA?
Under the US Fair Labor Standards Act (FLSA), overtime pay must be at least 1.5 times the regular hourly rate for all hours worked beyond 40 in a workweek. For example, if your regular rate is $20/hr, your overtime rate is $30/hr. Some states (like California) have daily overtime rules that kick in after 8 hours in a day.
What is time and a half?
Time and a half means your overtime hourly rate is 1.5× your regular rate. If you earn $20/hr normally, time and a half is $30/hr for overtime hours. This is the minimum required by the FLSA for hours over 40 per week.
When does double time apply?
Double time (2× regular rate) is not required by federal law, but some states and union contracts require it. California requires double time for hours over 12 in a single day, or for all hours on the 7th consecutive day of work in a workweek.
How do I calculate overtime for a salaried employee?
For salaried non-exempt employees, first calculate the regular rate: divide the weekly salary by the total hours worked.
